We the people, do hereby declare that fairness and justice be served with the action of a comprehensive restructuring of the existing Child Support laws. The present-day family court system is immoral, unfair and biased in that it violates the constitutional rights of non-custodial parents.
The enforcement of mandatory Child Support is itself illegal for the reason that it violates several of our civil liberties. It is a fallacy of the family court to say that they are working in the "best interest of the child." Such a fallacy distorts the general public’s thinking in order to keep the existing system--as is. The system does NOT have the best interest of the child in mind, or at heart. The best interest of the child is the involvement of both biological parents, or at least of one fit parent and the absence of an unwilling parent from his/her life, as no child should feel burdensome by merely existing. Unfortunately, there are many women who fraudulently become impregnated and use the current family court system as a "career move" due to the guaranteed funds they can obtain under duress from boyfriends and unsuspecting men who never agreed to fatherhood.
A vast majority of divorced men, and now some divorced women, absolutely do love their kids and want nothing more than to be in their children’s lives, but where the government FORCES these men and women against their own self-determination, to pay an amount that is far in excess of what the actual cost to raise a child is, (and in most cases have little or no visitation) it then serves only to destroy that being’s sense of liberty, dignity and survival potential. It's even worse when the non-custodial is branded a belittling term such as; DEADBEAT, for failing to create enough money to support the Obligor (Custodial Parent) and their own self and/or current family.
A greater frustration is that the money given to the custodial parent, in good faith, very often is used on personal gain and selfish needs, such as shopping, eating-out or paying the rent because they work very little or not all.
Why then, is the system dictating, under duress of punishment, how much a man or woman should pay toward their children anyhow?
For example; a happily married couple one day lose their jobs and they must place a strict budget upon their household bills so they can “make ends meet”. Why then, does the family law system not come in to their home and arrest those parents for not spending a calculated “bare minimum” on their children? Why are these parents empowered to tell their child, “no pizza, no take out, no cable, and no spending cash for the mall, internet,” etc.? It's simple… it's their God-given RIGHT to choose how the existing household budget is manipulated and so it should be for ALL.
Why should it be any different for a man or woman who is unwillingly divided from his or her children? People often fall on hard times and cannot create enough money to fulfil the mandatory support order. Existence is tough. Continued existence is tough. Anyone that is hit with too great a financial burden is liable to go insane, turn to crime, or commit suicide. The statistics are there to be found.
The Federal Government, State Government, and any such agency should never be permitted to interfere with the lives of parents, it's none of their business unless the child is in immediate danger due to recklessness, negligence or violence. Even then, in some instances, parents ought to be able to work things out via non-punitive mediation.
If child support payments (which are tax free and NOT considered Income for the custodial parent) were not so high, it is theorized that women would not be so quick to become pregnant. This theory is backed up statistically by viewing the pre and post child support laws in this country. When child support payments were raised and enforced, so too then was the number of women seeking such support and out-of-wedlock pregnancies. The sum of divorces increased one-hundred-fold since child support laws were introduced and modified. There are millions of testimonies all over the internet that attest to this tragic state of affairs.
Today, there is no such need for enforcement. All unwed and unplanned pregnancies, should never warrant the system intervening into the affairs of men and women.
